Reliure strictement de l'époque plein maroquin rouge, dos à nerfs janséniste avec seulement le titre doré dans un encadrement servant de pièce de titre, filet à froid en encadrement des plats, roulette dorée sur les coupes, doublures et gardes de papier peigne, tranches mouchetées de bleu et rouge. Impression sur papier vergé fort (grand papier). Reliure solide et en très bon état malgré quelques légères usures, frottements et marques (extrémité de la coiffe supérieure usée). Intérieur parfait. Edition originale. L'objectif principal de cette étude réside dans l'analyse économique du système pénal. Ce qui distingue alors cette approche, c'est l'idée novatrice selon laquelle les détenus doivent acquérir un métier afin de pouvoir subvenir à leurs besoins de manière autonome après leur libération. Par ailleurs, la création d'écoles pour les enfants issus des milieux défavorisés pourrait constituer un moyen de prévenir la délinquance en offrant des alternatives éducatives. Dans le cadre des idées des Lumières, Vilain XIIII, qui fut pendant longtemps président du Conseil de Flandre, est le premier à établir un lien explicite entre pauvreté et criminalité. Pour remédier à cette situation, il propose une réforme ambitieuse du système pénal et carcéral, visant à rééduquer les criminels. En 1771, une prison conforme à ses préconisations architecturales fut construite à Ackergem, près de Gand. Ce modèle comprenait notamment le fameux rez-de-chaussée radial, une conception qui exercera une influence notable sur la construction de prisons en France, au Royaume-Uni et aux États-Unis. (Voir Piet Lenders, Vilain XIIII, Louvain, 1995 ; Michel Foucault, Surveiller et punir, pp. 124-125). Cette uvre est pionnière sur la réforme pénitentiaire et s'inscrit parfaitement dans l'époque des Lumières. Loin des ouvrages purement théoriques sur le sujet, ce Mémoire donne un plan pratique et pragmatique pour parvenir au but rechercher : corriger les malfaiteurs et les fainéants tout en essayant de les réinsérer par le travail dans la société. On y trouve de très nombreux tableaux précisément chiffrés, des modèles d'actes et de rapports de police, des états généraux des détenus, de leur travail par métiers, de l'économie (comptes) au sein de la maison et des prisons en général, des règlements (noatamment un très intéressant Projet de Règlement de Police et de Discipline pour les Détenus, en 63 articles), des devoirs des directeurs et gardes, des effectifs, du moyen de trouver la subsistance des détenus, enfin les moyens pour extirper la mendicité de la société. Cet ouvrage sera réimprimé au format in-8 en 1841 (Bruxelles : Meline, Cans et Compagnie). Notre exemplaire, relié en maroquin rouge à l'époque, est très probablement un exemplaire de présent. Armoiries au titre, texte encadré ; quatre planches sur double page gravées par Bertaud, montées sur onglet.Ce remarquable mémoire fut à l'origine des principes fondamentaux du premier système pénitentiaire.Issu d'une très ancienne et très illustre famille belge, le vicomte Jean-Jacques-Philippe Vilain XIIII (1712-1777), bourgmestre de Gand, grand bailli, puis conseiller d'État, créa la maison pénitentiaire de Gand (1771-1774) ; elle servit de modèle aux grandes réformes de l'emprisonnement en France, en Angleterre et aux État-Unis. La maison de force de Gand ne renfermait pas seulement des mendiants et des vagabonds mais aussi des criminels. Cette institution était organisée autour du travail des prisonniers, car selon une enquête faite sur les condamnés dans la juridiction d'Alost, en 1749, montre que les malfaiteurs n'étaient pas « des artisans ou des laboureurs mais des fainéants voués à la mendicité ». De là, l'idée d'une maison qui assurerait en quelque sorte la pédagogie universelle du travail pour ceux qui s'y montre réfractaire et en redonner le goût à ceux qui l'ont perdu. Obligation du travail mais aussi rétribution, qui permet au détenu d'améliorer son sort pendant et après la détention.« L'homme qui ne trouve point sa subsistance doit absolument se porter au désir de se la procurer par le travail ; on lui offre par la police et la discipline ; on le force en quelque sorte à s'y livrer ; l'appât du gain l'excite ensuite ; corrigé dans ses moeurs, habitué à travailler, nourri sans inquiétude avec quelques profits qu'il préserve pour sa sortie, il a appris un métier qui lui assure une subsistance sans danger ».Très bon exemplaire. He most probably received this copy from the author (small handwritten note - from the author ?- tipped in on the first fly leaf). Most of this study concerns the economic side of the penal system. New is that prisoners ought to learn a trade, so as to fend for themselves once freed. Schools for the children of the poor could prevent mendacity. In line with the ideas of the Enlightenment , Vilain XIIII, who was a longtime Pensionary (president) to the Council of Flanders (the former County), is the first here to write on the link between poverty and crime. In order to remediate he proposes a rather radical reform of the penal - and prison system in order to reeducate criminals. In 1771 in Ackergem near Gent a prison, with the architectural outlay he advocated, was built . It included the famous radial groundfloor, an idea which had a large influence on prisons built in France, the United Kingdom and the United States. (See Piet Lenders; Vilain XIIII, Leuven 1995 ; Michel Foucault ; Surveiller et punir, pp 124-125). Interesting copy of the first edition of this pioneering work on prison reform along the lines of the Enlightenment.
